Terms of Service

These terms govern use of the TimeGate platform, including the web dashboard, the mobile app and the API. By using TimeGate you agree to them.

Where an employer has signed a separate written agreement with TimeGate, that agreement takes precedence over these terms wherever the two conflict.

Accounts

TimeGate accounts are issued by an employer to its own people. You may not share your credentials, and you are responsible for activity carried out under your account. Tell your employer promptly if you believe your account has been used by someone else.

The employer is responsible for who it grants access to, for the roles it assigns, and for removing access when someone leaves.

Acceptable use

You agree not to do any of the following.

  • Submit an attendance record on behalf of another person, except through a supervisor-assisted check-in that the employer has explicitly enabled.
  • Falsify location, network or photo data, or use any tool intended to defeat a verification check.
  • Probe, scan or attempt to breach the platform, or access data belonging to another company.
  • Reverse engineer the service, or resell access to it without written permission.
  • Upload unlawful content, malware, or material you have no right to share.

Customer data

Data entered into TimeGate belongs to the customer. We claim no ownership of it. We handle it to provide the service, as described in the Privacy Policy.

The customer is responsible for the accuracy of the data it enters and for the lawfulness of collecting it from its own people, including obtaining any consent required for location, network or photo verification.

Availability

We aim to keep TimeGate available continuously, but we do not promise uninterrupted service. Planned maintenance is scheduled outside peak hours where practical, and we give notice of work expected to cause downtime.

Attendance is a time-sensitive function. If the platform is unreachable, employers should keep a fallback record so hours are not lost.

Fees

Paid plans are billed in advance on the cycle agreed in the order. Fees are non-refundable except where required by law or stated in a signed agreement. We give at least 30 days notice before a price change takes effect on an existing subscription.

Termination

A customer may stop using TimeGate at any time. We may suspend or terminate access where these terms are breached, where fees go unpaid, or where continued use would expose the platform or other customers to risk.

On termination, the customer may export its data for 30 days. After that, deletion proceeds as described in the Privacy Policy.

Liability

TimeGate is provided without warranties beyond those that cannot be excluded by law. We are not liable for indirect or consequential loss, and our total liability is limited to the fees paid for the service in the 12 months before the claim arose.

Nothing here limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited.

Changes

We may update these terms. Where a change is material we give notice before it takes effect, and continued use after that date means the new terms apply.
